These Terms of Service govern your access to and use of the TucsonBolo website, online store, products, content, features, and related services.

Throughout these Terms, “TucsonBolo,” “we,” “us,” and “our” refer to TucsonBolo, operated by Jordan Levy. “You” and “your” refer to any person accessing the website, purchasing a product, or otherwise using our services.

By visiting our website, placing an order, or otherwise using our services, you agree to these Terms of Service and our Privacy Policy, Refund Policy, and Shipping Policy. If you do not agree, you should not access or use the services.

Our online store is hosted by Shopify, which provides the ecommerce platform that allows us to offer products and services to you.

1. Eligibility

You must be at least the age of majority in your state, province, or country of residence to make a purchase through the website.

If you permit a minor to use a product purchased through the website, you are responsible for supervising that use and ensuring it is appropriate and safe.

You may not use the services for any unlawful or unauthorized purpose.

2. Online Store Terms

You agree to provide current, complete, and accurate information when placing an order, creating an account, or communicating with us.

You are responsible for maintaining the confidentiality of your account credentials and for activity occurring through your account.

You may not reproduce, duplicate, copy, sell, resell, exploit, scrape, or commercially use any portion of the services without our prior written permission.

A violation of these Terms may result in the suspension or termination of your access to the services.

3. Products and Natural Materials

TucsonBolo creates and sells handcrafted bolo ties and related products featuring materials that may include natural stone, genuine leather, metal hardware, and other natural or handmade components.

Natural stone varies in color, veining, texture, pattern, polish, thickness, size, shape, inclusions, and surface character. Leather, metal, and handmade components may also exhibit natural or production-related variation.

These characteristics are not necessarily defects. They are part of what makes each piece unique.

Many TucsonBolo products are one of a kind. Unless otherwise stated, purchasing a particular listed piece means you will receive the specific bolo shown in the product listing. Products presented as examples, custom designs, collections, or made-to-order items may vary from photographs.

Product colors may appear differently depending on lighting, photography, display settings, and the device used to view the website.

Dimensions and measurements are approximate unless expressly stated otherwise.

4. Product Care and Use

Bolo ties should be handled with reasonable care.

Natural stone may crack, chip, scratch, discolor, or break if dropped, struck, crushed, exposed to extreme temperatures, or handled improperly.

Leather may change color, soften, stretch, dry, or develop a patina over time. Exposure to water, sweat, oils, chemicals, perfume, cleaning products, prolonged sunlight, or excessive humidity may affect natural stone, leather, adhesives, and metal components.

Do not immerse a bolo tie in water or use harsh cleaning products unless we have expressly confirmed that the method is appropriate for the particular materials.

Our products are fashion accessories and are not intended as toys. Small components may present a choking hazard. Keep products away from infants, unsupervised young children, and pets.

5. Product Availability

All products are subject to availability.

Because many items are one of a kind, an item may sell through another channel before inventory is updated on the website. This may include sales through retail partners, markets, pop-ups, social media, local transactions, or direct orders.

Adding an item to your cart does not reserve it. An order is not final until payment is successfully completed and we accept the order.

If an item becomes unavailable after you place an order, we may:

  • Cancel and refund the affected item;
  • Contact you to offer a replacement;
  • Provide alternative options; or
  • Arrange another mutually acceptable solution.

We do not guarantee that previously available products, stones, cords, colors, or components can be recreated or restocked.

6. Prices

Prices are shown in United States dollars unless otherwise stated.

Prices may change without notice. A price change will not affect an order that we have already accepted, except where required to correct an obvious error or as otherwise permitted by law.

Applicable taxes, shipping charges, customs duties, and other charges may be added at checkout.

Retail prices shown on our website may differ from prices offered by independent retail partners, at events, through wholesale arrangements, or through special promotions.

Discounts, promotional offers, and coupon codes:

  • May be subject to separate conditions;
  • May have expiration dates;
  • May apply only to eligible products;
  • May not be combined unless expressly permitted;
  • Have no cash value; and
  • May be modified or withdrawn where permitted by law.

7. Orders and Order Acceptance

Submitting an order is an offer to purchase the selected products.

We may accept, decline, limit, or cancel an order for lawful reasons, including:

  • Product unavailability;
  • Pricing or listing errors;
  • Suspected fraud or unauthorized activity;
  • Payment authorization problems;
  • Shipping restrictions;
  • Unusually large or commercial quantities;
  • Suspected resale inconsistent with an applicable agreement;
  • Violation of these Terms; or
  • An inability to fulfill the order as represented.

We may limit quantities purchased per person, household, account, payment method, billing address, shipping address, or order.

If we cancel an order after payment has been collected, we will issue a refund for the canceled portion using the original payment method, subject to payment-provider processing times.

8. Payment

You agree to provide valid, complete, and accurate billing and payment information.

Payments are processed through Shopify and third-party payment providers. Your use of a payment method may also be governed by the provider’s terms and privacy policy.

By submitting payment information, you represent that:

  • You are authorized to use the selected payment method;
  • The information provided is accurate;
  • The transaction is lawful; and
  • You authorize the applicable charges, including taxes, shipping, and other disclosed fees.

We do not generally receive or store complete payment card numbers.

A temporary authorization or pending charge may appear before an order is accepted or fulfilled.

9. Shipping and Delivery

Shipping methods, charges, and available destinations are displayed at checkout or described in our Shipping Policy.

Processing and delivery estimates are estimates, not guarantees, unless expressly stated otherwise.

Delivery may be affected by:

  • Carrier delays;
  • Weather;
  • Holidays;
  • Incorrect addresses;
  • Customs processing;
  • Natural disasters;
  • Labor interruptions;
  • Security events;
  • High order volume; or
  • Other circumstances outside our reasonable control.

You are responsible for providing a complete and accurate shipping address. Contact us promptly if you discover an error. We cannot guarantee that an address can be changed after an order enters processing or ships.

If an order is returned because of an incorrect or incomplete address, refusal, failure to collect the package, or another issue attributable to the recipient, additional shipping charges may apply before the order is resent.

International customers are responsible for applicable customs duties, import taxes, brokerage charges, and local fees unless expressly stated otherwise at checkout.

We will communicate material delays and provide remedies as required by applicable law.

10. Local Pickup and Delivery

We may offer local pickup, meetup, or delivery in the Tucson area.

The available method, location, timing, and any applicable fee must be agreed upon before the transaction is completed.

For safety, local meetups may be limited to public locations selected or approved by TucsonBolo.

An order designated for local pickup is not considered abandoned merely because it is not collected immediately. However, if an order remains unclaimed for an extended period and we cannot reach you, we may cancel or otherwise resolve it as permitted by law and the applicable Refund Policy.

11. Returns, Exchanges, and Refunds

Returns, exchanges, damaged-product claims, and refunds are governed by our Refund Policy, which is incorporated into these Terms.

Before purchasing, please review the Refund Policy for information about:

  • Return eligibility;
  • Return deadlines;
  • Product condition requirements;
  • Return shipping;
  • Exchanges;
  • Damaged or incorrect items;
  • Refund processing; and
  • Products that may be excluded from return.

Nothing in these Terms limits any non-waivable rights or remedies available under applicable consumer-protection law.

12. Custom and Personalized Orders

Custom and personalized orders may include special stones, cords, hardware, dimensions, colors, quantities, packaging, engraving, modifications, or other customer-selected characteristics.

Before production begins, we may require:

  • Written approval of the design or specifications;
  • Payment in full or a deposit;
  • Confirmation of the estimated price;
  • Confirmation of the estimated timeline; and
  • Approval of photographs, samples, or material options.

Natural materials cannot be duplicated exactly. Any sample, rendering, reference photograph, or prior piece is intended as guidance and not as a guarantee of an identical result.

Custom or personalized products may be final sale if that limitation is clearly disclosed before purchase, except where a return, refund, replacement, or other remedy is required by law.

Changes requested after materials have been purchased or production has begun may result in additional charges or timeline adjustments.

13. Wedding, Group, and Large Orders

Wedding-party, corporate, event, wholesale, and group orders may require additional lead time.

For coordinated sets, we may match products by color family, cord, hardware, size, style, or overall appearance. Because natural stone varies, coordinated products may not be identical.

Inventory availability and production capacity may change. A requested quantity or delivery date is not guaranteed until confirmed by TucsonBolo.

Separate written quotes, invoices, purchase orders, wholesale terms, or agreements may apply. Where a separate written agreement conflicts with these Terms, the separate agreement controls for that transaction.

14. Wholesale and Retail Partners

Wholesale purchases are intended for approved businesses and authorized retail partners.

Wholesale prices, suggested retail prices, minimums, payment terms, territory arrangements, display expectations, returns, replenishment, and other commercial terms may be governed by a separate invoice, purchase order, consignment agreement, wholesale agreement, or written communication.

Unless expressly agreed in writing, purchasing TucsonBolo products does not grant:

  • Exclusivity;
  • A protected sales territory;
  • Authorization to use our intellectual property beyond promoting authentic products purchased from us;
  • Authority to represent yourself as our agent; or
  • The right to modify, relabel, reproduce, or create derivative products.

Retail partners remain independent businesses and may establish their own retail pricing and customer-service policies, subject to applicable agreements and law.

15. Accuracy of Website Information

We try to provide accurate, useful, and current information, but the website may occasionally contain typographical errors, inaccuracies, omissions, outdated information, or technical problems.

Errors may relate to:

  • Product descriptions;
  • Prices;
  • Promotions;
  • Availability;
  • Shipping charges;
  • Processing times;
  • Delivery estimates;
  • Photographs; or
  • Product specifications.

We may correct errors, update information, or cancel affected orders where permitted by law.

Historical information may be provided for reference and may not be current.

16. Intellectual Property

The website and its content are owned by or licensed to TucsonBolo and are protected by applicable intellectual-property laws.

Protected content may include:

  • The TucsonBolo name and logos;
  • Product names;
  • Photographs;
  • Videos;
  • Product designs;
  • Illustrations;
  • Graphics;
  • Written copy;
  • Packaging;
  • Website design;
  • Blog posts;
  • Social-media content; and
  • Other creative materials.

You may view and use the website for personal, noncommercial shopping purposes.

You may not, without prior written permission:

  • Copy or reproduce our content;
  • Use our images to advertise unrelated or counterfeit products;
  • Remove watermarks or attribution;
  • Create confusingly similar branding;
  • Use our name, logo, or product photographs in a way that implies sponsorship or endorsement;
  • Scrape or systematically extract website content;
  • Train commercial systems using our proprietary content where consent is legally required; or
  • Manufacture, market, or sell counterfeit or unauthorized TucsonBolo products.

17. User Content, Reviews, and Submissions

You may submit reviews, photographs, comments, feedback, testimonials, ideas, or other content.

You retain ownership of your original content. By submitting content to us or tagging TucsonBolo in content intended for public sharing, you grant us a nonexclusive, worldwide, royalty-free, sublicensable license to use, reproduce, display, adapt, publish, and share that content for business, marketing, promotional, and social-media purposes, subject to applicable law.

We will not knowingly use private communications as public testimonials without permission.

You represent that content you submit:

  • Is accurate to the best of your knowledge;
  • Does not violate another person’s rights;
  • Is not unlawful, defamatory, deceptive, threatening, obscene, or malicious;
  • Does not contain harmful code; and
  • Does not impersonate another person.

We may remove or decline to publish content at our discretion where permitted by law.

18. Prohibited Uses

You may not use the website or services to:

  • Violate any law or regulation;
  • Infringe intellectual-property or privacy rights;
  • Submit false, deceptive, or fraudulent information;
  • Harass, threaten, abuse, or discriminate against another person;
  • Transmit malware, malicious code, or destructive technology;
  • Attempt to gain unauthorized access to systems or accounts;
  • Interfere with website security or operation;
  • Scrape, crawl, harvest, or collect information without authorization;
  • Conduct fraudulent purchases, chargebacks, or payment activity;

  • Misrepresent your relationship with TucsonBolo; or

We may suspend or terminate access where we reasonably believe these Terms have been violated.

We do not control all third-party services and are not responsible for their content, availability, security, accuracy, or practices.

Your use of third-party services may be governed by separate terms and privacy policies.

Links to third-party websites do not necessarily indicate that TucsonBolo endorses or controls those websites.

20. Privacy

Our collection, use, and disclosure of personal information are governed by our Privacy Policy.

By using the services, you acknowledge that information may be processed by Shopify and other service providers as described in the Privacy Policy.

21. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the website and services are provided on an “as available” basis.

Except for express warranties provided in writing and rights that cannot lawfully be excluded, we do not warrant that:

  • The website will always be uninterrupted, secure, or error-free;
  • Product descriptions or website content will be completely free from errors;
  • Every product will meet subjective expectations;
  • Natural materials will remain unchanged over time; or
  • Results obtained from use of the services will be identical for every customer.

This section does not exclude warranties, guarantees, or consumer rights that cannot be waived under applicable law.

22. Limitation of Liability

To the fullest extent permitted by law, TucsonBolo and its owner, employees, contractors, affiliates, representatives, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of the website, services, or products.

This may include loss of profits, revenue, data, business opportunity, goodwill, or other intangible losses.

To the fullest extent permitted by law, our total liability arising from a particular order or transaction will not exceed the amount you paid to TucsonBolo for the product giving rise to the claim.

These limitations do not apply where liability cannot legally be limited or excluded, including where applicable to fraud, intentional misconduct, gross negligence, personal injury, or non-waivable consumer rights.

23. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless TucsonBolo, its owner, affiliates, employees, contractors, representatives, and service providers from claims, liabilities, damages, losses, and reasonable expenses arising from:

  • Your unlawful use of the services;
  • Your violation of these Terms;
  • Your infringement of another person’s rights;
  • Content you submit; or
  • Fraudulent or malicious conduct associated with your account.

This provision does not require you to indemnify TucsonBolo for its own unlawful conduct, negligence, or other responsibility that cannot legally be shifted to you.

24. Termination

You may stop using the services at any time.

We may suspend or terminate access to the services if we reasonably believe you have violated these Terms, engaged in fraud or abuse, threatened the security of the services, or used the services unlawfully.

Provisions that by their nature should survive termination will remain effective, including provisions concerning payment obligations, intellectual property, disclaimers, liability, indemnification, and dispute resolution.

25. Severability

If any provision of these Terms is found unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed if necessary.

The remaining provisions will continue in full force and effect.

26. No Waiver

Our failure to enforce a provision of these Terms does not waive our right to enforce that provision later.

A waiver is effective only if made in writing by TucsonBolo.

27. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

We may assign these Terms in connection with a sale, merger, reorganization, transfer of assets, or similar business transaction, subject to applicable law.

28. Entire Agreement

These Terms, together with our Privacy Policy, Refund Policy, Shipping Policy, and any additional terms presented in connection with a particular product or transaction, constitute the entire agreement between you and TucsonBolo regarding the services.

Any ambiguity will not automatically be interpreted against the party that drafted the Terms.

29. Governing Law

These Terms and any dispute arising from the services or a purchase from TucsonBolo are governed by the laws of the State of Arizona, without regard to conflict-of-law principles.

Subject to any rights or venue requirements that cannot legally be waived, disputes will be brought in the state or federal courts located in Pima County, Arizona.

Nothing in this section prevents either party from bringing an eligible matter in small-claims court or exercising a non-waivable consumer right.

30. Changes to These Terms

We may update these Terms to reflect changes to our services, products, business practices, technology, or legal obligations.

The updated Terms will be posted on the website with a revised “Last updated” date.

Changes apply prospectively unless otherwise required or permitted by law.

Your continued use of the services after updated Terms take effect constitutes acceptance of the revised Terms.
